1. Acceptance of Terms

By accessing or using any website, mobile application, product, or service provided by Emergency Response Security Group (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Services.

6. User-Generated Content

You retain ownership of any content you submit, post, or display through the Services ("User Content"). By providing User Content, you grant ERSG a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, modify, and display such content solely for the purpose of operating and improving the Services. You represent and warrant that you have all rights necessary to grant this license.

7. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. ERSG does not warrant that the Services will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by law, ERSG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Services; or (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Services by any third party.

9. Indemnification

You agree to indemnify, defend, and hold harmless ERSG, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Services, your User Content, or your violation of these Terms.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct that we deem inappropriate or harmful.

11. Governing Law & Dispute Resolution

These Terms and any disputes arising out of or relating to them or the Services are governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Oregon to resolve any legal matter arising from these Terms.

12. Modifications to the Terms

We may update these Terms from time to time. We will post the revised Terms with a new "Last updated" date and, if changes are material, provide additional notice (e.g., email or prominent notice on our website). By continuing to use the Services after the revised Terms become effective, you agree to be bound by the updated Terms.
